            Petitioner aliens requested asylum and withholding of removal or, alternatively, voluntary departure. The immigration judge (IJ) denied the aliens' claims. The Board of Immigration Appeals (BIA) affirmed the IJ's without opinion. The aliens appealed

            The Virginia Court made the following holding:

  • Asylum can be granted by the Attorney General and, by delegated authority, the Board of Immigration Appeals and any immigration judge.
  • A refugee is an alien who is unable or unwilling to return to his country because of persecution or a well-founded fear of persecution on account of race, religion, nationality, membership in a particular social group, or political opinion. 8 U.S.C.S. § 1101(a)(42)(A). Therefore, the Board of Immigration Appeals or an immigration judge must first decide if someone is a refugee under § 1101(a)(42)(A) and then decide whether or not to grant asylum.
  • In the context of asylum and withholding of removal, the standard of review for these proceedings is extremely deferential to the finder of fact. The immigration judge's determination of the applicants' refugee status is reviewed under a substantial evidence test. The court can reverse only if any reasonable adjudicator would be compelled to conclude to the contrary. 8 U.S.C.S. § 1252(b)(4)(B).
