Facts:

            Petitioner Immigration and Naturalization Service (INS) sought review of a decision by the United States Court of Appeals for the Second Circuit, holding that the Attorney General abused his discretion in denying a motion to reopen deportation proceedings against respondent to allow consideration of respondent's claims for asylum and withholding of deportation, which the Attorney General had earlier withdrawn.

            The Federal Court made the following holding:

  • Motions for reopening of immigration proceedings are disfavored for the same reasons as are petitions for rehearing and motions for a new trial on the basis of newly discovered evidence. This is especially true in a deportation proceeding, where, as a general matter, every delay works to the advantage of the deportable alien who wishes merely to remain in the United States . 8 U.S.C.S. § 1253(a) provides that the Attorney General shall direct the alien be deported to the country designated by the alien if that country is willing to accept him into its territory, unless the Attorney General, in his discretion, concludes that deportation to such country would be prejudicial to the interests of the United States. Every request for asylum made after institution of deportation proceedings is also considered as a request for withholding of deportation under 8 U.S.C.S. § 1253(h); 8 C.F.R. § 208.3(b).
